These Terms of Service ("Terms") constitute a legal agreement between you (the "Customer") and Semental S.L.. By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use this website.

2. Age Requirement

You must be 18 years of age or older to use this website and purchase our products. This requirement reflects the Spanish legal age of majority and the minimum age for purchasing nicotine products under Spanish law (Ley 28/2005, as amended).

By accessing this site, you confirm that you are at least 18 years old. We employ age verification measures including:

  • An age verification gate requiring date of birth entry before accessing the shop
  • Date of birth verification at checkout, validated both client-side and server-side
  • The right to request additional proof of age at any time

We reserve the right to refuse or cancel any order where we cannot satisfactorily verify the customer's age. Orders placed by or on behalf of persons under 18 years of age will be cancelled and refunded.

3. Product Information

Red Stallion products are tobacco-free nicotine pouches intended for adult nicotine users only (18+). These products contain nicotine, which is an addictive substance.

Our products are:

  • Not suitable for pregnant or nursing women
  • Not suitable for persons with heart conditions or high blood pressure, unless advised by a doctor

Product descriptions and images on this website are provided for informational purposes and are as accurate as reasonably possible. Actual product appearance may vary slightly from images shown.

4. Pricing and Payment

All prices on this website are displayed in Euros (EUR) and are inclusive of Spanish IVA (Impuesto sobre el Valor Anadido) at the applicable rate (currently 21%). The price you see is the price you pay -- no additional tax is added at checkout.

Prices may change without prior notice. The price applicable to your order is the price displayed at the time you place your order.

Payment is processed securely through Stripe, a PCI DSS Level 1 certified payment processor. Semental S.L. does not store, process, or have access to your full payment card details. All card data is handled directly by Stripe in accordance with their security standards.

We reserve the right to refuse or cancel orders in cases of suspected fraud, pricing errors, or age verification failure.

5. Shipping and Delivery

We currently ship to addresses within Spain (ES) and Gibraltar (GI) only. Orders with delivery addresses outside these territories cannot be processed.

  • Standard shipping: EUR 5.99 (IVA inclusive)
  • Free shipping: on orders totalling EUR 50.00 or more (before any discount codes are applied)

Estimated delivery times are provided at checkout and are indicative only. Semental S.L. is not liable for delays caused by carriers, customs, or events beyond our reasonable control.

Risk of loss and damage passes to you upon delivery. An adult signature (18+) may be required upon delivery of nicotine products.

6. Right of Withdrawal and Returns

6.1 Your Right of Withdrawal

Under the EU Consumer Rights Directive (2011/83/EU) and Spanish consumer protection law (Real Decreto Legislativo 1/2007), you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason.

To exercise this right, you must inform us of your decision by a clear statement (for example, an email to [email protected]) before the 14-day period expires. The withdrawal period begins on the day after you (or a person you nominate) physically receive the goods.

6.2 Exemption for Opened Products

Important: Under Article 16(e) of the EU Consumer Rights Directive, the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons, once they have been unsealed after delivery.

Nicotine pouches are sealed products subject to health and hygiene requirements. Once a pack of nicotine pouches has been opened (seal broken), it cannot be returned under the right of withdrawal. This exemption exists because opened nicotine products cannot be resold or reused for health and safety reasons.

You may still return unopened, sealed packs within the 14-day withdrawal period.

6.3 How to Return

To initiate a return:

  1. Contact us at [email protected] within 14 days of receiving your order, stating your order number and reason for return.
  2. We will confirm your return request and provide return instructions.
  3. Return the goods in their original condition and packaging within 14 days of notifying us.
  4. You are responsible for the direct cost of returning the goods unless the goods are defective or incorrect.

6.4 Refunds

We will process your refund within 14 days of receiving the returned goods (or proof that you have sent them back, if earlier). Refunds will be issued to the original payment method used at checkout.

If the goods have been handled beyond what is necessary to establish their nature, characteristics, and functioning, we may reduce the refund to reflect any diminution in value.

6.5 Defective or Incorrect Products

In addition to the right of withdrawal, you are entitled to a remedy (repair, replacement, or refund) under EU consumer law if goods are defective or not as described. This right applies regardless of whether the product has been opened. Contact us at [email protected] with your order number and details of the issue.

7. Ambassador Referral Codes

From time to time, ambassador referral codes may be available that provide a discount on your order. Referral codes:

  • Are subject to the specific terms communicated with each code
  • Cannot be combined with other offers unless expressly stated
  • May be withdrawn or modified at any time without prior notice
  • Are validated server-side -- any attempt to manipulate discount amounts will be rejected
  • Cannot be used by the ambassador on their own orders

8. Intellectual Property

All content on this website -- including but not limited to logos, text, images, graphics, design, layout, and software -- is the property of Semental S.L. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from this website without our prior written consent.

The "Red Stallion" and "Saddle Up" names, logos, and associated branding are trademarks of Semental S.L..

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Semental S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of this website or our products.
  • Our total liability for any claim arising from an order shall not exceed the total amount paid by you for that order.
  • This limitation does not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Nothing in these Terms affects your statutory rights as a consumer under EU or Spanish law. Any mandatory consumer protection provisions that apply to you by virtue of your country of residence shall continue to apply regardless of any other provision of these Terms.

10. Data Protection

We process your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable national data protection legislation. 11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain.

However, if you are a consumer resident in Spain or another EU Member State, you shall benefit from any mandatory provisions of the consumer protection law of your country of residence that cannot be derogated by agreement. In accordance with Regulation (EU) No 1215/2012 (Brussels I Recast), Article 18, you may bring proceedings against Semental S.L. in the courts of the Member State in which you are domiciled.

Nothing in these Terms restricts your right to bring a claim before the courts of your country of residence, nor does it exclude any mandatory consumer protection rights afforded to you under Spanish law (including Real Decreto Legislativo 1/2007).

Online Dispute Resolution: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. You may use this platform to resolve any dispute arising from your online purchase.

  • EU Tobacco Products Directive (2014/40/EU): as applicable to nicotine-containing products
